What has our suit aginst Pacifica and the Election Supervisors accomplished SO FAR?
How about a really simple example?
EXAMPLE: Juan D'Eau requests a replacement ballot. He does not receive one. The election ends. He has been prevented from voting. The election supervisor opens all the other ballots, counts the votes for each candidate, and certifies the election results, without ANY vote being recorded for Juan D'Eau.
THAT IS WHAT WOULD HAVE HAPPENED IF WE HAD NOT BROUGHT SUIT AGAINST PACIFICA AND THE ELECTIONS SUPERVISORS.
HOWEVER, AS A RESULT OF OUR SUIT, NO VOTES WILL BE COUNTED UNTIL JUAN D'EAU RECEIVES A BALLOT AND HAS ADQUATE TIME TO RETURN IT, SO THAT HIS VOTE WILL BE INCLUDED.
It's as simple as that.
Oh, but didn't the Election Supervisors deal with that problem, by extending the election one week?
ANSWER:
NO! For two reasons.
(1) The ByLaws permit an extension ONLY if ballots have been counted and the number falls short of a quorum, and
(2) The Election Supervisors mailed some replacement ballots on THE LAST DAY OF THE EXTENDED PERIOD, i.e. post-marked Nov. 23 (in California); and some have not yet been mailed.
In other words, ONLY THE COURT ACTION WE WORKED TO OBTAIN PREVENTED THEM FROM RECORDING VOTES AND CERTIFYING RESULTS BEFORE PEOPLE REQUESTING REPLACEMENT BALLOTS RECEIVED THEM.
